Thanks for all the great answers. I’m still not completely certain what I will be doing.
The complete parcel of land my husband’s family bought originally is just under 60 acres, so my part will be right at 20 acres.
We (my husband’s and his 2 brother’s heirs) have tentatively agreed upon dividing the land in three sections, approximately 20 acres each. Soil Scientists confirm three perk sites for medium to large size homes on the section that will be mine.
My boys’ sections will each be just under 7 acres.
Also, when we finally get our real estate lawyer to prepare the new deeds, each of my boys and their cousin who owns adjacent land, will sign "right of first refusal" documents. That way, hopefully the land will stay in the family.
So, if I’m understanding the situation as I have presented it, there are just a couple of considerations…
If I subdivide the land now, the boys will not have to worry about any disagreements in the future, however, my sons will feel that I have no confidence in their ability to handle the situation… And it will have to be redivided once my youngest son is ready to sell his part.
If I leave the entire 20 acres together, it will show my confidence in them, as well as force them to work together, however, there is always a possibility that it could cause trouble between them. (The issue about who would be able to pay land taxes on their section each year would not be a factor as they will be inheriting money from life insurance policies after my death, and those monies will be under the administration of a trustee).
I think one thing I have not made clear is that the land will remain in my name until my death. Only after that time will the land be theirs.
I feel I know in my head that I could better set them up for success by having it divided now.
I just know that my boys have always felt that I had no confidence in them. I was hoping I might could address that in some small way with how I decided to handle the property over to them after my death.
